Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you and Yauheni Hlushankou, operating as ArcSmith Apps ("Eloquote," "we," "our," or "us") governing your use of the Eloquote Android app, including quote browsing, quote creation, saved collections, home-screen widgets, daily notifications, and premium subscription features.
By installing, using, or purchasing a subscription in Eloquote, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Eloquote.
Eligibility
There is no minimum age to use the free features of Eloquote, as the app does not require account creation or collect personal information. However, purchasing a premium subscription requires a Google Play account, which is subject to Google's age and eligibility requirements. If you are under the age of legal majority in your jurisdiction, you may need parental or guardian permission to make purchases.
Description of the Service
Eloquote is a quote browsing and collection app that provides:
- A curated library of quotes across 19 categories (Motivation, Stoicism, Life, Inspiration, Love, Wisdom, Mindfulness, Success, Happiness, Friendship, Courage, Gratitude, Leadership, Creativity, Self Improvement, Humor, Spirituality, Perseverance, Philosophy)
- The ability to create, edit, save, and delete your own quotes
- Home-screen widgets with customizable templates, colors, typography, and refresh schedules
- Daily quote notifications with flexible scheduling (smart schedule or custom time slots)
- Quote sharing via Android's standard share mechanism
- Theme customization (light, dark, or system default)
All user data (quotes, preferences, settings) is stored locally on your device. Eloquote does not use accounts, cloud sync, or remote storage for user content.
Free and Premium Features
Eloquote offers a free tier with limited functionality and a premium subscription ("Eloquote Pro") that unlocks additional features:
- Free tier: limited number of user-created quotes, basic widget templates, limited category selection, and one notification slot
- Premium tier: unlimited quote creation, all widget templates, all 19 categories, up to 5 notification slots, hourly widget updates, and all customization options
We may adjust the features included in each tier. Where required by law, we will provide advance notice of material changes that reduce the value of your current subscription.
Subscriptions, Billing, and Cancellation
Premium subscriptions are billed through Google Play. RevenueCat manages subscription verification on our behalf.
- Prices, billing frequency, trial terms, and auto-renewal details are disclosed at the point of purchase in Google Play
- Your subscription renews automatically unless you cancel before the renewal date through Google Play subscription settings
- Deleting the app does not cancel your subscription — you must cancel through Google Play
- Refunds, billing disputes, and taxes are governed by Google Play's terms and applicable law
- You can restore a previous purchase on the same Google Play account within the app
User-Created Content
You may create and save your own quotes within the app. Your user-created quotes are stored locally on your device and remain yours. We do not access, collect, or claim any rights over your user-created content.
When you share a quote using Android's share feature, the content is sent directly to the receiving app. You are responsible for ensuring that content you share does not violate the rights of others or applicable law.
Prohibited Conduct
You may not:
- Reverse engineer, decompile, or disassemble the app except as permitted by applicable law
- Circumvent subscription verification, premium feature restrictions, or other technical controls
- Redistribute, sublicense, or resell the app or its content
- Use automated tools to extract the quote library or other app content
Widgets and Notifications
Eloquote provides home-screen widgets and daily quote notifications that operate on your device. Widget display and notification delivery depend on your device manufacturer, Android version, battery optimization settings, and launcher. We are not responsible for issues caused by third-party launchers, OEM-specific restrictions, or disabled system services.
Intellectual Property
The Eloquote app, including its software, design, widget templates, branding, and curated quote library, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you.
Quotes included in the library are attributed to their respective authors. Many quotes are in the public domain or are widely attributed sayings. If you believe any content in the app infringes your rights, contact support.eloquote@arcsmithapps.com.
Availability and Changes
We may modify, update, suspend, or discontinue any part of Eloquote at any time, including the quote library, widget templates, notification features, or subscription benefits. Where required by law, we will provide advance notice of material adverse changes.
Termination
You may stop using Eloquote at any time by uninstalling the app. Remember to cancel any active subscription through Google Play before uninstalling. These Terms remain in effect as long as you use the app. Sections that by their nature should survive termination will survive, including intellectual property, limitation of liability, and dispute resolution provisions.
Disclaimers
Eloquote is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that every quote attribution is accurate or complete, that the app will function without interruption on every device, or that widgets and notifications will always display as expected across all Android manufacturers and launchers.
Nothing in these Terms excludes or limits rights that cannot be excluded under applicable consumer or other mandatory law.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, including locally stored quotes or preferences lost due to device failure, app updates, or clearing app data. Our aggregate liability arising out of or relating to Eloquote will not exceed the greater of (a) the amount you paid to us for Eloquote in the 12 months before the claim arose or (b) the minimum amount required by applicable law.
Governing Law
These Terms are governed by the laws of Poland, excluding conflict-of-law rules, except where mandatory local law gives you additional rights or requires a different forum.
If you are a consumer, nothing in this section deprives you of any mandatory protections under the laws of your country of residence.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice in the app or by other appropriate means. Continued use of Eloquote after the effective date of the updated Terms means you accept the revised Terms, unless applicable law requires additional action.
